Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and Vision Labs LLC, a limited liability company organized under the laws of the State of Arkansas, United States ("JourneyOS," "we," "us," or "our"). By accessing journeyos.app (the "Site"), joining the JourneyOS TestFlight, or using the JourneyOS mobile application (the "App," together the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that you have the legal capacity to enter into these Terms.

Pre-release and TestFlight access

Access to JourneyOS during the TestFlight period is provided at no cost. This is a pre-release version of the product. Features may change, be added, removed, or behave unexpectedly, and the Service may be unavailable from time to time. By participating in TestFlight, you agree to use the App for its intended purpose and acknowledge that pre-release software may contain errors or interruptions.

SMS communications

If you provide your phone number, you consent to receive SMS launch alerts from JourneyOS related to the Service. Message and data rates may apply, and message frequency varies. You may opt out at any time by replying STOP, or reply HELP for assistance. Consent to receive SMS is not a condition of using the Service. Additional details are in our Privacy Policy.

Your content

Content you enter into JourneyOS (such as Soul Profile responses, goals, journal entries, and check-ins) belongs to you. We do not claim ownership of your content. You grant us a limited license to store and process your content solely to operate and provide the Service to you. You can request deletion of your content at any time.

Acceptable use

You agree not to:

  • use the Service to harass, harm, defraud, or impersonate others;
  • reverse-engineer, decompile, scrape, or attempt to extract source code, except where such restriction is prohibited by law;
  • interfere with, overload, or disrupt the Service or its infrastructure, or attempt to gain unauthorized access to it;
  • use the Service in violation of any applicable law or regulation.

We may suspend or terminate your access immediately for any violation of these Terms.

Intellectual property

The Service, including its software, design, branding, logos, and content (excluding your content), is owned by Vision Labs LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

Disclaimers; no warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Vision Labs LLC does not warrant that the Service will be uninterrupted, secure, or error-free, or that any particular outcome will result from your use of the App. JourneyOS is a tool for reflection and habit formation; it does not provide medical, psychological, financial, or professional advice. Spiritual growth is a work of God, not software.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISION LABS LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (WHICH, DURING TESTFLIGHT, IS ZERO) OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless Vision Labs LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access at any time if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Governing law and disputes

These Terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict-of-law principles. You agree that the exclusive venue for any dispute arising from these Terms or the Service will be the state or federal courts located in Arkansas, and you consent to personal jurisdiction there. Before filing any claim, you agree to first contact us at the email below and attempt to resolve the dispute informally in good faith for at least 30 days.

Changes to these terms

We may update these Terms as the product evolves. When we make material changes, we will revise the "Last updated" date above and, where appropriate, notify active users by email. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
